Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Homemy mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Homemy is an AI-powered interior design application that allows users to upload photos of their rooms and receive AI-generated design suggestions. The App provides various style options and allows users to save their favorite designs.

3. Subscriptions & Billing

Homemy offers optional paid subscription plans ("Homemy Pro") that provide additional features such as unlimited design renders, higher quality output, no watermarks, and an ad-free experience.

Subscription Options:

• Monthly Subscription: Billed every month at the current subscription price.
• Yearly Subscription: Billed annually at the current subscription price. Includes a 3-day free trial for new subscribers.

Free Trial: The yearly subscription includes a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Payment: Payment will be charged to your Apple ID account at confirmation of purchase (or at the end of the free trial period, if applicable).

Automatic Renewal: Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Managing Your Subscription: You can manage or cancel your subscription at any time by going to your device Settings → Apple ID → Subscriptions, or by visiting https://apps.apple.com/account/subscriptions.

Refunds: Refund requests are handled by Apple in accordance with their refund policy. To request a refund, visit Apple Support.

4. User Responsibilities

By using our App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Only upload photos that you have the right to use
• Not upload any content that is offensive, harmful, or violates the rights of others
• Not attempt to reverse engineer, decompile, or disassemble any part of the App
• Not use the App to harass, abuse, or harm others
• Not attempt to gain unauthorized access to any portion of the App or its systems

5. Intellectual Property

The App, including its original content, features, and functionality, is owned by Homemy and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any photos you upload, but grant us a limited license to process them for the purpose of providing our service.

6. AI-Generated Content

The design suggestions generated by our AI are provided for visualization purposes only. While we strive for accuracy and quality, we do not guarantee that the generated designs will be suitable for actual implementation. We recommend consulting with professional interior designers before making significant changes to your living spaces.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Homemy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the App.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Homemy operates, without regard to its conflict of law provisions.

12. Apple's Terms

This App is licensed to you under Apple's Licensed Application End User License Agreement (EULA). By downloading and using this App from the App Store, you agree to be bound by Apple's terms in addition to these Terms of Service.
